conditions. Please DO NOT place an order with ListsMailing.com if you do
not agree with ALL our Terms of Service. |
| 1.) |
ListsMailing.com is not liable to replace duplicate records in the
client's database. A person may signup for similar offers at different websites
and at different times. |
| 2.) |
A 10%
margin of error is within the industry's standard when any data list is used.
i.e.: (3% postal error, 3% client opt-in typo error, 4-5% client relocation)
ListsMailing.com as a courtesy will supply the client with 10% additional leads
to help compensate for invalid and/or duplicate leads. Under no circumstances
can a client demand any additional compensation or refund for duplicate leads
or invalid leads. No overage/extra leads are ever provided on sale or clearance
items, discounted orders, special orders or specialty lists. We DO NOT
reimburse for any lost postage. |
| 3.) |
In no
event shall either party be liable for special, indirect, incidental, or
consequential damages, including, but not limited to, loss of use, or loss of
profits. |
| 4.) |
ListsMailing.com sells prospect lists only. All mailing lists are
created by actual consumers not us. All information is completely & solely
based on the consumer's accuracy and integrity when responding to one of many
national advertising campaigns. ListsMailing.com has no control over the
accuracy of such information and does not guarantee its accurateness or
completeness. We DO NOT guarantee sales or conversions. By placing your
order you agree that you CAN NOT chargeback citing dissatisfaction with
quality or service. |
| 5.) |
Client
agrees not to use the data in violation of any federal, state, or local law,
rule or regulation. ListsMailing.com agrees to provide all data and information
from recognized industry compilers and other sources. ListsMailing.com shall
not be liable for loss of profits, or for any other claims regardless of the
form of action. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER
EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTIBILTY OR
FITNESS FOR A PARTICULAR PURPOSE. |
| 6.) |
The
relationship between ListsMailing.com and the Client will be governed by, and
construed in accordance with, the laws of the State of Pennsylvania. Client
hereby irrevocably consents to the exclusive jurisdiction of the courts of the
State of Pennsylvania and the federal courts situated in the State of
Pennsylvania in connection with any action arising between the
parties. |
| 7.) |
If any
of the terms are held unenforceable, the reminder of the terms shall remain in
effect. |
| 8.) |
ListsMailing.com reserves the right to terminate or edit this
agreement anytime, with or without cause. Termination notice may be provided
via email or by any other public means and will be effective
immediately. |
| 9.) |
By
agreeing to this Agreement, the Client warrants that Client (or Authorized
Representative of the Client) is at least 18 years of age, and that there is no
legal reason that Client cannot enter into a binding contract.

Your
order is generated to your specifications therefore ALL SALES ARE FINAL AND
NO REFUNDS CAN OR WILL BE GIVEN. |
| Changes to these Terms & Conditions This policy may be
amended from time to time, consistent with the requirements of the terms &
conditions. |
